These general terms and conditions of sale (GTC) form the basis of commercial negotiations and are systematically sent or given to each buyer to enable them to place an order.
The general terms and conditions of sale described below detail the rights and obligations of MONSIEUR TOM MARCEAU and its customer in connection with the sale of the following goods: Musical instruments or parts of musical instruments
Any acceptance of the quote/purchase order implies the buyer's unreserved acceptance of these general terms and conditions of sale.
The prices of goods sold are those in effect on the day the order is placed. They are denominated in euros and calculated excluding taxes. Consequently, they will be increased by the VAT rate and shipping costs applicable on the day of the order.
Marceau Guitars reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is placed.
A deposit of 50% will be required to confirm a custom-made instrument.
Payment of the deposit implies the buyer's unconditional acceptance of these terms and conditions of sale.
The deposit is non-refundable in the event of cancellation of the order by the buyer, for any reason whatsoever.
Custom-made instruments require different production times depending on the model and options.
The usual production times are:
- 6-8 months for instruments with Neck
- 10-12 months for instruments with Neck
- 16-24 months for Custom Shop instruments
Production times may vary and cannot be used as grounds for cancellation.
Payment for orders is made by bank transfer
For individuals: Payment of the balance will be made upon receipt of the invoice, before delivery of the instrument.
For professionals: Payment will be made upon receipt of the goods.
In the event of total or partial non-payment for goods delivered by the due date, the buyer must pay Marceau Guitars a late payment penalty equal to three times the legal interest rate.
The legal interest rate applied is that in force on the date of delivery of the goods.
This penalty is calculated on the total amount including tax remaining due, and runs from the due date of the price without any prior formal notice being necessary.
In addition to late payment penalties, any amount, including the deposit, not paid on its due date shall automatically give rise to the payment of a fixed compensation of €40 for recovery costs.
Articles 441-10 and D. 441-5 of the French Commercial Code.
If, within fifteen days of the implementation of the "Late Payment" clause, the buyer has not paid the outstanding amounts, the sale will be automatically terminated and may give rise to the award of damages to Marceau Guitars.
Retention of title clause
Marceau Guitars retains ownership of the goods sold until full payment of the price, including principal and incidental costs. As such, if the buyer is subject to receivership or judicial liquidation, Marceau Guitars reserves the right to claim, within the framework of the collective proceedings, the goods sold and remaining unpaid.
Delivery is made by carrier to the buyer's delivery address or can be collected directly from Marceau Guitars
The delivery time indicated when the order is placed is for information purposes only and is not guaranteed.
Consequently, any reasonable delay in the delivery of the products shall not entitle the buyer to claim damages or cancel the order.
The risk of transport is borne entirely by the buyer.
The order must be checked in the presence of the delivery person; you are liable in the event of a dispute.
It is essential that you check the condition of the goods before signing the delivery receipt, which is binding on you.
No claims will be accepted in the absence of specific and detailed reservations made in writing in the presence of the delivery person.
In the event of missing or damaged goods during transport, the buyer must make all necessary reservations on the order form upon receipt of the goods. These reservations must also be confirmed in writing within five days of delivery, by registered letter with acknowledgment of receipt addressed to the company.
In accordance with the legal provisions in force, the customer may exercise their right of withdrawal from the GTC once their order has been confirmed and up to fourteen (14) days after delivery of the product without having to justify their reasons or pay a penalty.
In order for the withdrawal period to be respected, the customer simply needs to send their notification of withdrawal before the expiry of the withdrawal period.
If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased and the shipping costs* will be refunded to the customer (*on a flat-rate basis of a maximum of €20 including tax for shipping costs), with the direct costs of return shipping remaining the responsibility of the customer.
Marceau Guitars will inform the customer by email or telephone of the terms and conditions for returning or collecting the product. If the product is to be returned by the customer, the latter must return the product at their own expense, without undue delay and, in any event, no later than fourteen (14) days after the customer has communicated their decision to withdraw from this contract. This deadline is deemed to have been met if the customer returns the product before the expiry of the fourteen (14) day period.
The product must be returned to Marceau Guitars in its original condition and complete (packaging, accessories, instructions, etc.), clean, and in a condition that allows it to be resold as new. The customer must enclose a copy of the purchase invoice with the returned product.
Products that are dirty, in poor condition, or incomplete will not be accepted.
The customer may operate the product in order to establish its nature, characteristics, and proper functioning. However, the customer may be held liable in the event of depreciation of the product not resulting from normal use of the product.
The customer will be refunded the full amount no later than fourteen (14) days from the date on which Marceau Guitars is informed of the customer's decision to exercise their right of withdrawal. The refund will be made when Marceau Guitars receives the product.
Marceau Guitars cannot be held liable if the non-performance or delay in the performance of any of its obligations described in these general terms and conditions of sale results from a case of force majeure. In this respect, force majeure refers to any external, unforeseeable, and unavoidable event within the meaning of Article 1148 of the Civil Code.
Any dispute relating to the interpretation and execution of these general terms and conditions of sale shall be governed by French law.
If no amicable resolution can be reached, the dispute shall be brought before the Commercial Court of Rennes (Cité judiciaire, 7 rue Pierre Abélard, 35000 Rennes).
