Purpose and scope

The present general terms and conditions of sale (GTCS) form the basis of commercial negotiation and are systematically sent or handed to each purchaser to enable them to place an order.
The general terms and conditions of sale described below detail the rights and obligations of the company MONSIEUR TOM MARCEAU and its customer within the framework of the sale of the following goods: Musical instruments or parts
Acceptance of the quotation/order form implies the buyer's unreserved acceptance of these terms and conditions of sale.

Price

The prices of the goods sold are those in force on the day the order is taken. They are denominated in euros and calculated exclusive of tax. Consequently, they will be increased by the rate of VAT and transport costs applicable on the day the order is placed.
Marceau Guitars reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

Down payment

A 50% deposit is required to validate a custom-made instrument.
Payment of the deposit implies the buyer's unreserved acceptance of these general terms and conditions of sale
The deposit is non-refundable in the event of cancellation of the order by the buyer, for any reason whatsoever.

Custom-made instruments

Custom-made instruments require a different lead time depending on the model or options.
The lead time generally observed is:
- 6/8 months for instruments with screwed Necks
- 10/12 months for instruments with glued Necks
- 16/24 months for Custom-Shop instruments
The lead time may vary and cannot be used as an excuse for cancellation.

Terms of payment

Orders must be paid for by bank transfer
For private customers: The balance must be paid on receipt of the invoice, before delivery of the instrument.
For professional customers: The balance must be paid on receipt of the invoice, before delivery of the instrument: Payment is due on receipt of goods.

Late payment

In the event of total or partial non-payment of goods delivered on the due date, the purchaser must pay Marceau Guitars a late payment penalty equal to three times the legal interest rate.
The legal interest rate applied is that in force on the day of delivery of the goods.
This penalty is calculated on the amount due, inclusive of tax, and runs from the due date of the price, without the need for any prior formal notice.
In addition to late payment penalties, any sum, including the deposit, not paid by the due date will automatically give rise to the payment of a flat-rate penalty of 40 euros to cover collection costs.
Articles 441-10 and D. 441-5 of the French Commercial Code.

Resolutory clause

If, within fifteen days of the implementation of the "Late payment" clause, the purchaser has not paid the outstanding sums, the sale will be automatically cancelled and may give rise to a claim for damages against Marceau Guitars.

Retention of title clause

Marceau Guitars retains ownership of the goods sold until full payment of the price, in principal and in accessories. In this respect, if the purchaser is the subject of receivership or liquidation proceedings, Marceau Guitars reserves the right to reclaim, within the framework of the receivership proceedings, the goods sold and remaining unpaid.

Delivery

Delivery is made by carrier to the purchaser's delivery address, or by collection directly from Marceau Guitars
The delivery time indicated when the order is registered is given for information only, and is not guaranteed.
Consequently, any reasonable delay in the delivery of products will not entitle the purchaser to claim damages or to cancel the order.
The risk of transport is borne entirely by the purchaser.

The order must be inspected in the presence of the delivery person, and you will be held liable in the event of a dispute.
It is imperative that you check the condition of the goods before signing the delivery receipt, which is binding on you.

No claim can be accepted in the absence of precise and well-founded reservations written in the presence of the delivery person.
In the event of missing or damaged goods during transport, the purchaser must make all necessary reservations on the order form on receipt of the said goods. These reservations must also be confirmed in writing within five days of delivery, by registered letter with acknowledgement of receipt addressed to the company.

Right of withdrawal

In accordance with the legal provisions in force, the customer may exercise his right of withdrawal from CGV once his order has been validated and up to fourteen (14) days after delivery of the product, without having to justify his reasons or pay any penalty.

In order for the withdrawal period to be respected, it is sufficient for the customer to transmit his communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased and the shipping costs* will be reimbursed to the customer (*on a maximum flat-rate basis of €20 including VAT for shipping costs), with direct return costs remaining at the customer's expense.

Marceau Guitars will inform the customer by e-mail or telephone of the procedures for sending or taking back the product. If the product must be returned by the customer, the latter must return the product at his or her own expense, without undue delay and, in any event, no later than fourteen (14) days after the customer has communicated his or her decision to withdraw from this contract. This deadline is deemed to have been met if the customer returns the product before the fourteen (14) day deadline has expired.

The product must be returned to Marceau Guitars in its original and complete condition (packaging, accessories, instructions, etc.), clean, and in conditions allowing it to be remarketed as new. The customer must enclose a copy of the purchase invoice with the returned product.

Products that are dirty, in poor condition or incomplete will not be taken back.

The customer may operate the product in order to establish its nature, characteristics and proper functioning. However, the customer may be held liable in the event of depreciation of the product not resulting from normal use of the product.

The customer will be reimbursed for all sums paid no later than fourteen (14) days from the date on which the Marceau Guitars boutique is informed of the customer's decision to exercise his right of withdrawal. Reimbursement will be made when Marceau Guitars receives the product.

Force majeure

Marceau Guitars may not be held liable if the non-performance or delay in performance of any of its obligations described in these terms and conditions of sale is due to force majeure. Force majeure is defined as any external, unforeseeable and irresistible event within the meaning of article 1148 of the French Civil Code.

Competent court

Any dispute relating to the interpretation and execution of these general terms and conditions of sale is subject to French law.
Failing amicable resolution, the dispute will be referred to the Commercial Court of Rennes (Cité judiciaire, 7 rue Pierre Abélard, 35000 Rennes).

25€ maximum.
• Le paiement en 4 fois à partir de 100€ d’achat et jusqu’à 3000€
Exemple : Pour un achat de 400€, apport de 109,60€ puis 3 mensualités de 100€.
Crédit sur 3 mois au TAEG fixe de 21,61%. Coût du financement : 9,60€ dans la limite de 50€
maximum.
Conditions particulières pour les offres promotionnelles ponctuelles : Pour le paiement en 3 fois sans
frais : le coût du financement est de 0% du montant total de la commande. Exemple pour un achat de
150€, apport de 50€, puis 2 mensualités de 50€, Crédit d’une durée de 2 mois au TAEG fixe de 0%.
Coût du financement : 0€. Pour le paiement en 4 fois sans frais : le coût du financement est de 0% du
montant total de la commande. Exemple pour un achat de 400€, apport de 100€, suivi de
3mensualités de 100€. Crédit d’une durée de 3 mois au TAEG fixe de 0%. Coût du financement : 0€
